SD921. Richard Barrett’s Republication of Last Will and Codicils

July 5th 1838
I Richard Barrett hereby confirm my will republished on the seventh of March 1838. Since the date of that republication I have become possessed of other Lands in the parish of St Ann which Lands I bequeath to my brother George and his Heirs for ever. I have also become possessed of a Pen called Union, lying in the Parish of St Catherine. I give that Pen in also and the stock and implements of Husbandry thereon, and on the St Anns lands above mentioned to my brother George. And I charge Union with the payment of one hundred pounds per annum to Emily Gaynor, during the term of her natural life, being in addition to the provision already made for her in my will. Should the said Emily Gaynor have any children at the time of my death, I give to each of her children, one thousand pounds, current money of Jamaica—and if she be enciente I leave to same sum to her issue born after my death providing she be then living with me, and forming part of my establishment and I desire that the interest of the said sums be applied to the support and education of the said children, at the rate of six per cent per annum and that the principal sum of one thousand pounds be paid to the males when they respectively reach the age of twenty-one and to the females on the day of marriage or at the age of twenty-one, whichever shall first happen. And I further give to Emily Gaynor the free use and occupation of my house called Tydenham and of all the furniture, bed and table linen, and plate that may be therein at the time of my death, during the term of her natural life. I also give and bequeath to her twenty-five cows and their calves, each cow to have two calves and followers, and a Bull; all which are to be selected for her by some person whom I shall appoint, out of all the stock I may possess in St Anns at the time of my death. I also bequeath to her for her life only the one hundred and forty acres of land belonging to Tydenham and the Guinea Grass pieces planted by [illegible word] Benneta in the year 1837 and forming part of Taws’s. I also give to the said Emily Gaynor exclusive of the annuities which I desire to be paid her in four equal quarterly payments the sum of twenty doubloons to be paid to her as soon as possible after my demise and I further direct that Tydenham house and buildings be left in good repair at the expense of my St Anns properties. In addition to Dr George Longmore and my brother George, I appoint my nephew S. G. Barrett an Executor of my Will and of the Codicil–
And whereas I bought on the 23rd of June Last of the Honble Robert Allwood a Sugar Estate, lying in the Parish of Hanover and called Harding Hall I give and bequeath my said Estate to Richard the eldest son of my nephew S. G. Barrett. My will is that the proceeds of the said Estate shall be applied in the first place to the education and maintenance of the said Richard and that the remainder shall be enjoyed by my nephew S. G. Barrett until his son attains the age of sixteen years, after which time the surplus shall be vested in proper securities to be transferred to the said Richard with the Estate when he shall reach the age of twenty-one and should the said Richard not attain the age of twenty-one I leave the Estate and the accumulation to my said nephew Saml G. Barrett. I give to my relation Richd Godsell Waite, fifty pounds a year to be paid half yearly. I give to Jeanette the daughter of Jake Taylor twenty pounds a year to be paid quarterly. And whereas I may die before the several properties I have purchased are fully paid for, & whereas my brother George and my nephew Sam. G. Barrett, who will benefit most largely by this will, have already sufficient incomes for their support, Therefore that my intentions may not be thwarted, I desire that no money shall be taken from my Estate by my said brother and Nephew for their own use, until all my engagements entered into for the purchase of the above mentioned properties and all my debts of every description be fully paid and satisfied, and to include in the said restriction the bequest to my grandnephew Richard. And it is my desire that no division of my property shall take place until all debts and engagements to which I am at my death liable, be fully paid and satisfied, and I leave it to the discretion of a majority of my executors to determine whether the personal property of which I may die possessed such as plate, furniture, horses, carriages, be sold or retained for my heirs & in the respective houses or properties which at the time of my death contain them.

Having since the signing of the above Codicil, bought a piece of land from Saml Simpson joining on my land called Wem, and also a Penn call Charlton Kings from Thomas Ashmeade Esqrboth in the parish of St Anns; I do bequeath both properties and all other lands I am possessed of in St Anns, with the stock, plantation utensils and furniture thereon and other personal property, if my Executors do not sell the same for the paying out of my debts as before provided for, to my brother George Goodin Barrett; his customs and assigns. And that no dispute may arise concerning the distribution of my personal property, I will that notwithstanding any thing above written to the contrary, my said persoanl property meaning the furniture, plate, horses, carriages, books, and other such household and personal effects, always excepting that I have devised to Emily Gaynor, be peremptorily sold by auction, if it shall appear that my debts exceed one year’s income of my Estates– Should however my debts not amount to the sum, I leave the above named personal property to follow the devise of the several houses where it may be found at my decease, and in addition to the Executors before named, I appoint John Edward. Esqr, Receiver General of this Island, an Executor of my last Will. I do hereby confirm my will and the Codicils annexed thereto and have set my hand and seal– Richd Barrett.
