My dear Sam
I received by last Packt your letter intimating your safe arrival in Engd after so perilous a voyage as yr [sic] must have been– I came here last monday to attend the opening of the house on Tuesday, we came to the determination of the last house of Assembly to enter into no business until the Proclamation laws were withdrawn, & the house had established its priviledges [sic]– The Governors speech was answered in that tone on Friday when he summoned us over to the Council Chamber & Prorogued us till the 5th Feby giving him time to receive his instructions from Engd My belief is that he will resign– He is more & more unpopular every day & shows evidently that he dislikes the inhabitants of the land of Springs
The Specials are running a course which if not speedily checked must terminate in the general destruction of Property– Their adjudications are of the grossest & most unjust description & are certainly tending to do away with the rights of property in which they are supported by the executive– I have transferred two cases of mine upon which they have adjudicated to the Cornwall Assize court I have Middletons opinion upon it & a most satisfactory one it is not only on my own account, but likewise for the Island in general– My Uncle has signed the Power of Attorney, appointing Cooke his attorney in Engd to compromise our long & tedious Suit if your Father is willing so to do & I am going to forward it by this Packt I am going to ascend the Blue Mountain Peak tomorrow & shall return to the north side during the week when I will deliver yr messages &c Many th<an>ks for yr kind offers to execute any c<omm>issions for me– I am going <to> ask you to purchase me four Kings <Pattern> silver salt spoons at Savory & Coxes, as well as a silver flat horisontal [sic] watch for myself, & a good strong second hand hunting one for Charles– Pray like a good fellow come out soon as I am sadly in want of someone to bully– Remember me kindly to Bro & the rest of yr circle, & for God[’s] sake use yr influence with yr Father to endeavour to bring our unfortunate differences to a close & compromise this damnable suit– I have left Maria & the Children at Greenwood all well[.] If any thing you wish done here pray write to me & I will execute it for you[.]

Enclosure, in unidentified hand: Heads of Agreement. / Barrett &c - vs - Plummer. / Mr Moulton waives 7/8ths of the Commissions charges in the accounts stated by Master Howell in the above Cause. / Mr Moulton agrees that the sum of one thousand four hundred, thirty one pounts 16/1¾ shall be deducted from the amount of his accounts against Cambridge and Oxford plantations, for interest charged in those accounts by Mr Howell and objected to./ Mr Moulton agrees that the amount of all monies paid by Mr Plummer on account of those plantations to persons whose demands may have erroneously been introduced by Mr Moulton in his accounts, shall be deducted or set against the demand of him Mr Moulton. / Mr Moulton agrees that whatever sums he may have received which are not brought to the credit of the different properties of Barretts shall be credited & deamed [sic] to be set off against his demands. / Mr Moulton agrees to leave the charges in his accounts against the Falmouth Wharf to the consideration & determination of Mr McAnuff / It is understood and agreed by all parties that Mr Moulton shall be entitled to and allowed on interest (after all deductions on the accounts aforesaid) or whatever balance may result to be due to him on the 20 day of February 1806 when he delivered up possession of the properties to Mr Scarlett—that balance to be paid in bills of Exchange at one and two years sight drawn without interest. / Mr Moulton agrees that upon receiving such bills of Exchange to give a general release and acquitall [sic] for all claims against the different properties. / It is agreed by all parties that Mr McAnuff shall carry their intentions as hereinbefore expressed into effect as soon as possible / Signed: Robt Moulton / P.
