Mr Robertson hath just now brought the inclosed letter to us, and desired we would forward it to you.
The Judgment obtained by your Grandfather’s Executors was for Money due from Mr Robertson to him in his Lifetime and the Action States it to be due on the 14th of Novm 1798 which we presume was Shortly before your Grandfathers Death[.] The Claim Mr Robertson makes is for the Costs of the Ejectment Miles and other vs Scarlett and others which was Subsequent to your Grandfathers Death—Mr Robertson being ap<poi>nted the Surveyor for your Grandfather Executors in June Court 1799– Mr Robertson complains that he could not prove his Set off in regard to this Ejectment because Mr Lamont his Witness did not attend– But it appears to us that if his Witness had attended, the Court could not allow him to give Evidence of this Claim, in as much as it was a Demand against the Executors arising after the Death of your Grandfather– But at the Same time we think Mr Robertson ought to have Credit either upon the Judgment for the Amount or to be paid what Shall appear due to him Since your Grandfathers Death– Two years may be perhaps too long a Time to have it Settled, but if Mr Robertson executes the Title to the Land and which we understand he is ready to do, we think a reasonable time ought to be allowed him to make out his Claim in Jamaica to the Satisfaction of the Executors, and to allow the Same in part of the Judgment–
