Gentlemen
We enclose a letter from Mr Barrett to you, we cannot discover that Mr S. Barrett or his representative ever availed themselves of the Judgment in Ejectment wh. they recovered for a moiety of the Retreat. Mr R. Barrett however has no disposition to put Mr S Barrett to the expense & trouble of reviving his Judgment and issuing a list of possessions thereon & He has therefore directed the overseer of Thatchfield to admit Mr S Barrett as receiver into the joint possession with himself Mr R. Barrett of this property. The claim however that Mr Barrett should account for a moiety of the pimento picked on this land claims the time that Mr Barrett was in possession of the real estate of Edward Barrett the elder as Receiver is quite inadmissable. If we understand the matter right Mr Barrett was in sole possession of this land as the attorney of the Trustees of his brother Mr Samuel Barrett at the time he was appointed the receiver of the real estate of Edward Barrett. We submit therefore that he is only accountable to those Trustees for any rents & profits he might have received & that the claims of Mr S. M Barrett (if any he has) is by an action in law against these Trustees as his Co[-]Tenants in common for the excess of the rents & profits wh. they have received beyond their |share|.
