Dear Sir
Sir Joshua Rowe handed to me yesterday in Kingston your letter to him of the 9th inst. with a request that I would obtain and send to you the Will Bond on your Uncle’s estate and also reply to such parts of your letter on which you were desirous of having information connected with the estate.
I now enclose you the Will Bond with Mr Robert Dewar’s memo as the Surety. I have thought the sum of £20,000. quite sufficient to be included in the Bond which after execution please return and I will procure the further papers, to return the Inventory, which I will send you down with instructions.
With reference to the Stock on Cinnamon Hill Cornwall and the Retreat I should consider that only the increase of such Stock as were on those properties at the time of your Uncle’s coming of age would pass with the properties to your Father, and that all stock purchased by your Uncle and their increase are part of his personal estate. From the absence of any valuation at the time when your Uncle came of age I should think it would be fair to consider the number at Edward Barrett’s death as the fair proportion to pass with the properties and that the residue should be deemed your Uncle’s. Further than to ascertain the distinct interests it appears to me of little importance which are or are not your Uncle’s property, as your father will take the residue under his Will.
With respect to the Emblements of the Crops the Jury usually grant 1/3d for the expenses, and give the remaining two thirds to the Executor of the Tenant for life. The value has been given on properties, where a heavy expence was incurred in the carriage to the barquadier, and I should think the expenses would be less when the Wharf is so near to the properties.
