Dear Sir,
I have received your favor of the 16th inst. The Island Secretary will not deliver out of office the further papers to return the Inventory until the Bond is returned to him. I may mention that you are allowed six months to prepare and send in the Inventory, but the moment you return the Bond no delay shall take place in forwarding the remaining papers
I was aware of the Clause in Mr Edward Barrett’s Will at the time I last wrote to you, but taking into consideration that no valuation was made on your Uncle’s coming of age and that it would be now impossible to determine the number at that time, I was and still am of opinion that the terms of that Clause in the Will would be deemed to have been complied with if such a number as were necessary for the properties were considered as attached thereto, and in the absence of data for that purpose the number at Edward Barrett’s death would be I should think the best guide. If the fact could be ascertained then what were on the Estate when your Uncle came of age should be considered as your Father’s. As, however, he will take the residue under your Uncle’s Will, it does not appear to me that your Father will practically suffer.
Sir Joshua Rowe mentions that you wished to papers for ascertaining the Emblements should be sent you. No steps can be taken in this matter until the Grand Court, and if your Father’s attorney applies for the possession of the Estates he is entitled to have it, and to take off and ship all produce manufactured since your Uncle’s death. You <can> ship all that was made previously, and can take <the Bi>lls of Lading. The Writ of Emblements |issues| to determine what amount in money or produce the next remainder man is to pay to the tenant for life for the Crop on the ground at the latter’s death, and proceeds on the presumption that the tenant in tail has entered into possession and taken the crop which he is entitled to do.
